Washington, for example, requires all operators to submit an accountability report that includes details about the facial recognition provider, the purpose and scope of the deployment, measured system performance, and a data management policy that describes how the information is used and protected. This report must be submitted at least 90 days prior to deployment, published online and updated every two years. The bill in Arizona would introduce a similar requirement.

At the local level, each city listed in Table 1, with the exception of Nashville, requires authorities to provide an impact assessment and usage policy when requesting permission to purchase a facial recognition system. Financial firms are also interested in facial recognition to speed up identity checks. Incode, a San Francisco-based identity verification startup, says its facial recognition verified more than 140 million identities in 2021, about four times more than in the previous three years combined. The company`s clients include HSBC and Citigroup, and it recently received $220 million in funding from investors such as JP Morgan. In Virginia, legislation that went into effect last July prohibited local law enforcement and campus police from using facial recognition technology unless the state legislature first passed a rule authorizing it. The state`s 2022 legislation, which went into effect in July, essentially reverses that 2021 rule by allowing the technology to be used by local police and campus police in certain situations. The consent requirement would raise the issue of passers-by for facial recognition technology, which supports individuals for whom companies cannot meet notification and consent requirements. But like Washington, Colorado and Virginia offer businesses safe havens to “prevent, detect, protect or respond to security incidents.” Some state legislators take a similar approach to Washington in their general privacy laws. These laws do not specifically target facial recognition, but regulate the use of biometric information (which includes many forms of facial data) among the many types of personal data they cover.
