ADC Legal supports many Arab Americans who experience discrimination and harassment in the workplace because of their Arab ethnicity. When Arabs are discriminated against in the workplace, ADC Legal investigates the complaint, provides legal advice on the federal anti-discrimination law, and helps them file complaints with the Equal Employment Opportunity Commission (EEOC). ADC Legal regularly provides legal advice to Arabs seeking immigration assistance and information on refugee status, temporary protected status, and asylum in the United States. CDA also provides assistance with the filing of immigration applications and applications. In some cases, ADC Legal takes on a case and represents people who are destitute or in a unique legal situation that has national implications. Since the beginning of the program, the ADC, several members of Congress, and many civil rights activists have raised questions about the constitutional legality of NSEERS discrimination based on national origin. We urge you to contact public officials, including the media, and request that the NSEERS program be completely completed. In fact, Asa Hutchinson, then Under Secretary of State at DHS for Border and Transportation Security, said at the 2004 ADC convention, “We hope to completely end this particular registration program because our long-term goal is to treat everyone equally, not where you`re from.” The ADC found that 84,000 Arabs and Muslims volunteered and 14,000 of them were later expelled for voluntarily participating in the program. But none, not a single one, of these registrants has been charged with terrorism. In December 2004, the NSEERS program was amended by the Department of Homeland Security, but many elements remain and are subject to abuse, including: the recording of departures; registration at ports of entry; as well as the possibility of restarting the convocation phase. It seems clear that NSEERS has become another tool used in immigration and law enforcement in general, raising serious constitutional questions, as the program clearly discriminates on the basis of national origin. Since 1980, CDA`s legal department has striven to simultaneously address a consistently high workload and to firmly defend the rights of Arab Americans on a number of important political issues. In late 2002, the Department of Justice`s Immigration and Naturalization Service (now known as the Department of Homeland Security-DHS and its component agency Immigration and Customs Enforcement-ICE) launched a campaign known as the National Security Entry and Exit Registration System (NSEERS) with special phases of call-based registration.
