Importance of Legal and Ethical Considerations

In this discussion, students will critically reflect on the differences and similarities between legal and ethical norms. Use these questions to stimulate in-depth discussion and reflection on these concepts. People`s quality of life can be improved through legal and ethical standards designed to ensure that no one in society is threatened by terrorism or criminal behaviour. Ethical standards are formulated in accordance with societal norms. Heads of government create legal norms in the form of laws and laws. Ethical standards are based on human notions of right and wrong, which is why they are important. When it comes to ethical and legal standards, not everything that is legal is always legal. The definition of legal norms is a set of principles based on laws promulgated by the Government. The statutes and laws cited by lawyers are based on law. Legal provisions are useful because they tell people what they cannot do.

Those who break the law can be held liable if legal standards are in place. Cyber-mapping offers rich potential for traditional knowledge mapping, as described earlier in this chapter, but this knowledge is much more than a collection of “artifacts” that can be placed on a map. It is part of a knowledge system that is often fundamentally different from dominant Western systems. Chapter 19 addresses the legal issues associated with protecting communities` rights to knowledge and promoting a culture of respect, not only for individual knowledge, but also for the integrity of the knowledge system from which it originates. Existing rights, such as copyright, intellectual property and data ownership, have limited value because they are based on individual rights rather than collective or community rights. What is needed are completely new perspectives on legal and ethical issues, including greater consideration of soft law solutions. The Affordable Care Act is an example of a series of laws that have been developed with a number of ethical issues in mind. Due to pre-existing conditions or simple unavailability, tens of millions of people have not been able to purchase health insurance at all costs. The law corrects this injustice by requiring most U.S. citizens and permanent residents to purchase health insurance (Lachman, 2012). The law also addresses insurance choices and costs and introduces certain rights and protections for consumers. Clinical ethics is a discipline or methodology used to examine the ethical implications of medical technologies, policies, and treatments, with particular attention to determining what should or should not be done in health care (Brock & Mastroianni, 2013).

The main ethical and legal considerations concern research participants. It is the responsibility of the researcher to protect and preserve the privacy, dignity, respect, privacy and protection of research participants. There are topics that are controversial in nature, the author should obtain the consent of research participants before publishing controversial or personal information about research participants. It is best to avoid disclosing the names and identities of research participants. The main difference between legal and ethical standards lies in the basis of each concept. Authors and researchers have an ethical obligation to ensure the accuracy, publication and dissemination of research results[4] and to disclose relevant corrections, retractions and errata to publishers in order to protect the scientific integrity of published evidence. All research studies involving humans must be registered in a publicly accessible database (e.g. ANZCTR [Australia and New Zealand], ClinicalTrials.gov [US and non-US], CTRI [India]) and the results must be made public. [4] Clinical trial sponsors must grant all researchers and manuscript authors access to the full study dataset and have the right to use all study data for publication. [5] Source documents (with study data) and clinical study reports (study results and interpretation) are essential documentation that must be retained for a period required by applicable local legislation.

[1] The ICMJE currently proposes a requirement for authors to share anonymized individual patient data underlying outcomes in articles in member journals. [18] Moral conscience is a precursor in the elaboration of the legal rules of the social order. Data may be subject to access restrictions related to ethical and legal issues. These restrictions must be set before the data is published to the repository. Most research institutions have an office of experts in research and/or law and ethics who can provide advice in this area. In addition to a “copyright” statement, a “rights” and “access rights” statement can be included in the metadata record to explicitly specify data restrictions. It may also be necessary to enter into a user agreement to determine how other researchers may use the data collection. Some data collections are subject to an embargo period or require mediated access (e.g., an email request to the collection owner) or can only be accessed by a particular group of researchers (e.g., researchers from the same research centre). In these cases, the repository software must be able to support these conditions.

Ethically and legally have different meanings, although they both aim to ensure that people live well. Ethical means carrying the value of distinguishing good from bad behavior, while legal means acting in accordance with the law. Informed consent may be obtained from a legally authorized representative if a potential research participant is unable to give informed consent[4] (children, mental disability). The participation of these populations must be conditional on their being able to benefit from the results of the research. [4] The “legal representative” can be a spouse, close relative, parent, power of attorney or legal guardian. The hierarchical hierarchy of priorities of the representative may vary from country to country and region within the same country; Local guidelines should therefore be consulted. Fidelity is fidelity or loyalty. This is a testament to the special relationship that has developed between patients and their health care provider. Each owes allegiance to the other; Although the greatest burden rests with the medical provider, the patient must increasingly assume some of the responsibility (Beauchamp & Childress, 2001).

Fidelity often leads to a dilemma because a commitment to a patient may not lead to the best outcome for that patient. The root of faithfulness is the importance of keeping a promise or staying true to one`s word. The individual sees things differently. Some are able to justify the meaning of the promise at almost any cost, and others are able to set aside the promise when an action could be detrimental to the patient. The Affordable Care Act also addresses the ethical principles of charity (kindness) and non-malevolence (do no harm) by establishing affordable health care exchanges and plans. Exchange is part and parcel of the complicated problem that arises when health care is compulsory. It is based on the concept that requiring health insurance without affordability would cause significant harm to individuals and families in financial difficulty (Lachman, 2012). Physiotherapist managers regularly encounter a variety of issues, many of which involve legal and ethical issues. Managers who have risen through the ranks or gained supervisory status through clinical expertise or years of service may be ill-equipped to recognize and address these issues.

This chapter attempts to answer the most common legal and ethical questions faced by physiotherapist managers. Basic and applied ethics are discussed alongside the specific problems of the managed care environment. Medical malpractice, sexual harassment, and labor law are under review, and these issues are followed by a discussion of federal laws that affect the practice of physiotherapy. Ethical standards, on the other hand, do not necessarily have a legal basis. They are based on the human principles of good and evil. For example, if you try to park your car in a parking lot and there is only one parking space left, the only legal standard you must follow is not to exceed the speed limit or crash into another car. Now, if you see another car going to that place, ethical standards tell you not to fight for space, but to give room to the car that was there first. It is the right thing to do. This is an ethical standard. Imagine you were the one walking around the place right now, and someone was walking by and parking there. You would feel treated unfairly, and yes, you have been wronged, ethically.

Legal and ethical norms are rules and principles that people in the same society are familiar with. For example, if you live in the United States, you will be familiar with the laws of the country. You will also learn about the ethical standards of American society.

If You Get Married in Antigua Is It Legal in the Us

Your wedding ceremony will be performed by a wedding officer appointed by the State of Antigua and Barbuda and legally recognized on the island. The day and time of the ceremony can be agreed by both parties and can usually be performed after a day`s work. If the wedding is to take place outside the courthouse, a fee of $675.00 or US$250.00 will be charged to the marriage officer. More and more people are getting married on vacation, and in Antigua and Barbuda, it`s easy now. Visitors to cruise ships can now get married. There are three simple steps: visit the Department of Justice on Lower Nevis Street in downtown St. John`s with your valid passports, complete the application and pay the applicable fees. Events Management Antigua specializes in the creative development and flawless execution of many types of events. Website: www.eventsmanagementantigua.com/ Are there any other legal requirements? Both parties must be over 15 years of age, if they are under 18 years of age, written permission from your parent or guardian is required.

It is important that all documents submitted are original or certified by the issuing bodies. Make sure all documents are in your legal name and make affidavits if you are known by another name. Your marriage must also be solemnly concluded or solemnized in the presence of two or more witnesses in addition to the marriage certificate. (Just ask one or two guests to do it for you). It is often necessary to apostille or legalize documents before marriage. Getting married in Antigua and Barbuda is as simple as 1, 2, 3. Brides and grooms must report to the Department of Legal Affairs in St. John`s simply present a valid passport, complete the application and pay the applicable fee. However, due to ongoing Covid-19 logs, this must be done by making an appointment with @legalaffairs@ab.gov.ag If you think it`s too time-consuming or complicated to get married, but still want to celebrate vows abroad, consider a symbolic wedding. In this case, you can get married at home and then go through the ceremony at your destination, knowing that you are already legally married. Once you have your special license, you can get married in Antigua and Barbuda right away! When planning, keep in mind that the wedding ceremony should take place between 6 a.m. and 8 p.m.

With three simple steps, Antigua and Barbuda can be considered one of the easiest Caribbean islands to marry. As there is no residency requirement, it is possible for couples to marry within 24 hours of arrival. Beautiful sunsets and romantic nights could inspire you to get married without much foresight. And it could be possible. On some islands, a short waiting period or a stay of several days is necessary. Almost all of them require legal proof of who you are and that you are single if you were already married. So if you think you want to do it legally, take your documents with you. Is marriage legal? Of course, this is both legal and binding. In addition, both parties must agree to accept each other as husband and wife. As in most places, to get married on the island, you must be over 18 years old and have two witnesses.

And since there`s no residency requirement, you can get married on the day you land. If you want to get married in Antigua and Barbuda, there are certain legal requirements and documents that you need to bring with you to ensure that your special day goes with a breakdown. Can I get married in a church? Yes, but this requires permission from the church authorities where you want to get married. Ask your pastor to contact the church to determine the requirements. Some churches require the couple to participate in marriage counseling. Allow a little extra time if you are planning a church ceremony. Your ceremony will be performed by a wedding officer appointed by the State of Antigua and Barbuda and legally recognized on the island. On the eve of the celebrities` wedding, the Ministry of Tourism held a cocktail party at the copper and wood store to honor both the married couple and the celebrity couple.

The event also launched a diamond hunting contest as part of the romantic action, featuring the Nelson Shipyard as one of the most romantic places in Antigua and Barbuda. The diamond hunt takes place in www.antiguabarbudaevents.com and continues until the end of October. When a U.S. citizen legally marries a person abroad, that marriage is recognized as legal in the United States if it was legally performed and is valid under the laws of the foreign country. However, there can be some legal complications at the state level – for example, due to the position on same-sex marriage – so you should check the website of the attorney general of the state where you want to live. If you`re planning a Caribbean wedding, it`s important to know what you need to do to be legally married. Laws, requirements, and costs related to marriage vary from country to country on the islands. Since the legal requirements for a wedding in Antigua and Barbuda change over time, you should check the official government website for more details. This up-to-date information can be found here.

What about documents? What do we need? You will need both valid passports as proof of citizenship. If one of you has ever been married, bring the original divorce decree or, in the case of a widow or widower, the original marriage and death certificates. For a copy of the marriage certificate application, please click here for the PDF form. Unfortunately, we cannot obtain marriage documents on your behalf. However, we are happy to assist you in preparing documentation (Affidavit of Marriage Eligibility (Affidavit of Individual Status), Preliminary Translation, U.S. Department of State Apostille/Legalization and Consular Legalization Services in Washington, DC. Please contact us or get a quote if you know what documents you need. To prepare for the wedding, you need to follow three steps to meet your legal obligations. The following original legal documents are required when applying. You must fax or scan and email the required documents to the Ministry of Legal Affairs, Public Safety and Labour prior to the Zoom meeting.

The Lattimores married five years ago in a similar romantic setting at a wedding in Jamaica, commenting that they were “honored to be part of such an important event that symbolized the unity between couples, families and community.” There are more than 10 officials on the island to make sure you get the date you want. – If one of the parties has changed its name by documentary study or adoption, proof is required. It is important that original documents, including passports, are brought to the hotel. Anything that is not in English must be translated into an English document, which must be signed and stamped by a lawyer stating that it is the authentic translation of the original. Tips for crossing the U.S. border into Canada with your children While you are at the Department of Justice, both parties must be present and you will have to prove that you are both single. If you are divorced or widowed, you must provide divorce documents or a death certificate. The best times for outdoor weddings are before 11am or after 4pm when the sun is coolest.

The Ministry of Justice is open Monday to Thursday from 8:30 a.m. to 4:30 p.m. and Friday from 8:00 a.m. to 3:00 p.m. Flights arriving in Antigua after 15:00 do not allow couples to get to the Department of Justice in time to apply for the special marriage certificate. In such cases, the couple may agree that the marriage will take place either the day after the application process ends, or any day thereafter. Confirm a date and time for the ceremony with a wedding officer and on the big day, you will receive your marriage certificate at the end of your ceremony, which usually lasts only 15 to 20 minutes at civil weddings. May 2007) As Antigua and Barbuda continues to celebrate June as the month of romance, love was in the air at the Hermitage Bay Hotel, the site of this year`s celebrity destination, Wedding. Every marriage must be solemnly concluded or solemnized in the presence of two or more credible witnesses. The first step is to go to the Department of Justice in downtown St. John`s with your valid passports. You must then complete the licence application. Finally, you pay some necessary fees. The marriage license fee is usually $150. Here are the three simple steps to same-day marital happiness in Antigua and Barbuda: Tourism Minister Harold Lovell demonstrated the destination`s commitment to this promotion and was one of the witnesses and signatory on the couple`s marriage certificate. Mrs.

Skepple was the acting wedding officer and prayers of thanksgiving were offered by the Reverend Carlsen Christie. Derede Samuel Whitlock, Director of Tourism for the United States, said: “The wedding was very special and everyone present was able to feel the love that this destination on a twin island has to offer. We expect that with celebrity participation, the event will provide significant media exposure to the destination and help us position ourselves as the “romance capital” of the Caribbean. The romantic event on land was a fanfare of pink and tropical flowers.

Ice Hockey Enforcer Rules

The answer isn`t exactly simple, and even avid hockey traditionalists are beginning to question the relevance of combat in today`s modern sport. The truth is that a combination of tradition, the physical nature of hockey and the need to intimidate the opponent is ultimately the reason players are allowed to fight hockey. So, let`s dive a little deeper into the nuance. As mentioned earlier, ice hockey fighting is a concept that has been etched into the game since the league`s inception. For nearly 100 years, Rule 56 has stated that in-game combat is allowed, but with consequences. Therefore, many fans believe that changing or eliminating a rule that has been intertwined in the game for 100 years would drastically change the game on many levels. Law enforcement sometimes starts fights to create game dynamics and provide a psychological advantage over the opposing team. These battles usually involve two executors, but also each player who disturbs the opponent. [8] This type of fight boosts morale in the winning player`s team, and often thrills the home crowd. For this reason, it can also be a gamble to start a struggle for momentum; If an executor loses the battle, the momentum can tip in the wrong direction. [62] Barbarian or not, hockey is a fast-paced and physical sport. Tempers can heat up and some players simply lose their temper. Fighting in this situation offers players the opportunity to vent their frustrations while taking revenge or revenge on their opponent.

Before two players engage in a hockey game, it usually starts with an argument to trigger it, whether it`s a hit against a team`s superstar, a previous “bad blood” between two players, etc. In addition, players are not allowed to remove their helmet before the battle begins. This leads to a minor penalty and unsportsmanlike punishment. Fighting has been a part of ice hockey since its inception. But when the Fisticuffs really took off, it was during the 1970s. During this particular decade, it was not uncommon to see fights on the bench during a professional hockey game. Fighting is an established tradition in North American ice hockey, with a long history that spans several levels of amateur and professional play and includes some notable one-on-one fights. [1] Fights can be fought by enforcers or “thugs”[2] – players whose role is to fight and intimidate – in a specific team,[3] and are subject to a system of unwritten rules that players, coaches, officials and the media call “the code”. [4] Some fights are spontaneous, while others are performed intentionally by the participants. [5] Although officials tolerate fights during hockey games, they impose various penalties on players who fight. Although fighting was rarer from the 1920s to the 1960s,[26] it was often brutal in nature; Author Ross Bernstein said of the game`s early years that it “probably looked more like skate rugby than modern hockey.” [7] Star players were also known to fight for themselves during the Original Six era, when fewer teams existed than in the following years.

However, as the expansion of the NHL in the late 1960s created more spots on the roster and spread star players throughout the league, executors (who usually have limited general skills) became more common. [28] Several struggles during this period received considerable media attention. [29] During an NHL preseason game between the Boston Bruins and St. Louis Blues in 1969, Bruins defenseman Ted Green and Blues left winger Wayne Maki engaged in a bloody battle with sticks. The fight initiated by Maki resulted in a fractured skull in Green. [28] [30] In 1978, Dave Hanson, head of the Birmingham Bulls of the World Hockey Association, known for his 11-year professional career, fought Hall of Famer Bobby Hull and received Hull`s wig in his joints. The incident got Hanson talking, and angry Winnipeg fans tried to attack him as they walked out of the arena. Hanson appeared in the 1977 film Slap Shot, a comedy about violence in hockey.

[32] Some hockey viewers who are new to the sport and some to WWE might feel that hockey fights are somehow staged. According to the rules, Eller was in error and then went into the penalty area. According to the unwritten rules of the game, however, Marchand was wrong because he had not accepted the fight.

2. Where a legal obligation is limited by the word `practicable`, the obligation is fulfilled if it is `practicable` or `practicable in the light of current knowledge and technology`, taking into account published information, relevant UK or international guides or standards. 62. Stresses the importance of workers reporting all cases of illness to their superiors, as they may be work-related. This is especially important if employees work where rats may be, or if the area has been used for illegal drug use and associated utensils can be found. Refurbishment and renovation work can result in residues from previous residents that can cause health problems. 2. Contractors are typically on-site and able to meet their legal obligations by directly controlling labor and monitoring on-site health and safety standards. In comparison, contractors at large companies are typically not site-based, and it is common for them to delegate responsibility for day-to-day compliance with the law to on-site employees such as site managers. Site managers may need to further delegate responsibility for monitoring the health and safety aspects of certain work activities to trade regulatory authorities. Whatever the circumstances, the obligation to comply with health and safety rules rests with contractors. 7. In the event of a dispute over a decision on what was reasonably feasible or not, the burden of proof in court that all reasonably practicable measures were taken rests with the contractors.

1. Where legislation imposes legal obligations on contractors with regard to the health and safety of their workers, similar obligations shall generally be imposed on self-employed persons with regard to ensuring their own health and safety. 10. Explain the site procedures or commercial procedures that must be followed when gas, electricity, telecommunications, fibre, water, sewage and other buried services are discovered on the site. 11. You may need to inform employees and others of the skill levels required to operate certain types of equipment or perform certain operations. In particular, the CDM obliges any person who hires or hires a worker to carry out construction work to ensure that he or she is competent to do so. 1. In addition to legal considerations, such as compliance with this regulatory document, there are very important economic and social drivers for sound health and safety policies and their proper implementation. The economic argument is that if there are fewer accidents on site and no work-related illnesses, more workers will be at work instead of sick. This means better business continuity with a greater prospect of completing projects on time, on budget and with customer satisfaction.

The company will investigate the possible presence of asbestos in its offices and on the sites where it operates and, if asbestos is detected, will properly manage it and record its presence in the asbestos registry. 6. In this regard, under the CDM, each contractor, subcontractor and designer is required by law to consult each other on construction work and changes during planning and design, and they are all required by law to provide the necessary information for future phases of the project (after construction). 20. If there is more than one contractor in the workplace, they must cooperate on health and safety matters so that both contractors (or all if there are more than two) can comply with their legal obligations. Companies can apply to the Technical Assistance Sector of the Public Works Authority “Ashghal” to register for the Occupational Health and Safety (OHS) system through project consultants from 1 to 7 of each month. If there is no project consultant, an Ashghal project manager takes over this task. The purpose of this system is to monitor OSH performance in the field.

The registration of consultants in the OSH monitoring system is carried out by the Ashghal-affiliated Quality and Safety Department. 9. Reasonably feasible: If a legal requirement is qualified by the term “reasonably practicable”, the cost (in terms of money, time and inconvenience) of precautions can be weighed against the risk contemplated. 1. Contractors are required by law to bring their health and safety policy and any subsequent changes to the attention of all employees. The CDM emphasizes the need to consult with those who perform the work. Communicating health and safety policy is a good way to achieve this. 6.

The regulatory document is intended to assist customers, designers, contractors, subcontractors and others in fulfilling their legal, moral and social responsibilities and assisting them in critical areas: 1. CDM regulations shall establish legal obligations for construction planning and management agreements. It imposes obligations on all persons involved in construction, and contractors have a number of specific obligations under the CDM. 4. Contractors must ensure that employees are trained and competent for the work they are required to perform. The fact that they cannot communicate in the language of the country of residence does not mean that workers are not competent in their occupation. If they are here legally, it would be extremely unwise to ban workers who can prove their competence simply because they do not speak the language effectively or fluently. Precautions can and should be taken for such situations. 5. This is a key legal act on occupational health and safety in Qatar and focuses on the construction industry, which imposes legal obligations arising from the concept of project planning.

It focuses on the planning, design and management of construction projects and imposes legal obligations on everyone involved in the plant and construction. 3. In practice, a legal obligation qualified by the term “practicable” cannot be set aside on the ground that compliance with it would slow down the construction programme, be costly, difficult or otherwise inconvenient. 4. Where a legal obligation is limited by the phrase “reasonably practicable”, contractors are entitled to judge the extent of the measures that must be taken to ensure the health and safety of persons performing the work and other persons likely to be affected by the work. 58. Due to the secretive nature of illicit drug use, these items may be hidden, which may increase the danger to those who find them. Employees should be warned to be very vigilant, especially when it comes to detecting used injection syringes, razor blades (needle injuries and needle sticks). Provides an overview of the legal framework for the main elements of OSH legislation. Provides comprehensive legal information and analysis.

73. The crucial needs arising from risk assessments and methodological explanations are safe work systems. Explain that site rules require employees to work in accordance with all safe work systems developed by contractors. 15. Contractors shall apply the procedures to be developed to deal with particularly serious and imminent dangers. It depends on both the activities of the contractors and the location. Fires pose a real risk to everyone almost everywhere, but bomb threats in rural areas may not be. 4. It is customary for the policy statement to indicate the importance that the company attaches to the health and safety of its employees and what is required of them to achieve the objectives of the policy. It should also be made clear that all workers will be informed of the content of the health and safety policy and will be consulted on its application. The Company will ensure, to the extent possible, that hazardous substances are handled, transported, used and stored in a manner that does not affect the health of any person by their presence. 2.

Information should be provided in the context of the advance award or tendering procedure and responses to identified problems can be of real assistance in assessing the competence of candidates for the works. It must therefore be identified, compiled and dispatched in a timely manner so that those who need it for the preparation of the tender or for the preparation of the works can decide on the resources (including time) necessary for the design, design and construction work to be properly organised and executed. If design work continues during the construction phase, information must be provided to designers prior to the start of work on each new design element. If subcontractors are appointed during the construction phase, each subcontractor (or work seekers) must receive the information in good time before construction so that they can take it into account when preparing their tender or preparing work on site. 16. Make employees aware of the company`s health and safety policy and its changes. 47K Conduct risk assessments for all operations performed and document key findings of the risk assessment. 1. Those rules shall require each person involved in a project to coordinate his or her activities with each other in such a way as to ensure, as far as possible, the health and safety of persons: 7. Qualified person: a person who has practical and theoretical knowledge and actual experience of the work to be performed.

In some cases, a person`s competence is concretely demonstrated by the award of a qualification or other recognition of the training acquired. 9. There will undoubtedly be other issues specific to a company or site, and these will need to be taken into account and developed by the company concerned. 40K Explain that at the end of the introductory session, all inductees must provide their name and signature on an attendance sheet indicating that they understood what they were told.

How to Write an Abstract for Law Article

A summary is a short summary – one to three paragraphs – of an article. Some journals add an abstract at the beginning of the article, or place all abstracts from an issue in the issue`s table of contents, or post abstracts on the journal`s website. These journals ask you to either write the summary or offer to write it for you. Decline their offer and write the summary yourself: it`s your article, and you`ll know better how to summarize it effectively. The abstract should describe the most important aspects of the study and contain only a limited number of details about its context, methodology and results. Authors should critically evaluate the various aspects of the manuscript and select those that are important enough to be included in the abstract. That would be too much simplification of the article`s assertion, but that`s fine – any summary of a sentence that lingers in people`s minds will inevitably be too much simplification. It is important to note that if the topic presents itself to readers in the future, they can search, find, read, and use the article. And if the author is lucky, maybe some readers will be interested enough to read the article immediately, or at least switch from reading the abstract to reading the introduction. And the audience for your ad is quite demanding.

You usually only found the summary by quickly browsing an SSRN email or a table of contents in the legal journal. (People who find the article through a Westlaw or Lexis citation or search are more likely to go through the introduction that is immediately available to them than to start with the abstract.) Readers of your summary are therefore not at all sure that the article will be useful to them. Here, for example, an adequate abstract is appropriate, as it quickly captures the essence of the added value of the article: What`s wrong with using the first person in an article abstract in the submission phase? Letters of inquiry and book proposals always use the first person, as do research programs. Why should a submission abstract be different (as opposed to the ultimate abstract at the beginning of a published article, which roughly matches the cover of a book)? The second sentence explains the article`s assertion: The original meaning of the First Amendment probably includes symbolic expressions. Readers who stop reading will at least remember something like, “There`s an article that says even originalists should approve of court decisions.” * Although this is the first section of your article, the abstract should be written at the end as it summarizes the content of all your research. But even if the journal doesn`t publish an abstract, you should still write one. Services such as the Social Science Research Network (see page 265) maintain email distribution lists through which hundreds or thousands of subscribers receive abstracts of upcoming articles. These mailing lists are invaluable for you to attract readers to your work. After all, your article is the most important thing ever written, isn`t it? Other people who have written about the same thing have tried to do things right, but your new idea is also so amazing? And you have a recommendation for improvement or a different point of view? Just like my new way of writing summaries? * An abstract usually consists of 150 to 500 words; Therefore, it should be written very precisely, but concretely. Abstracts of manuscripts submitted to the BMC series biological journals should be structured as follows: If you find it useful, explain how to write an abstract for research papers* Then, write down the help or connection points or words to make the flow clear, smooth and complete. * Before submitting your final research/manuscript, check that the information in the abstract is completely consistent with what you wrote in the research. And to add even more analogies, when sending investigative letters to fiction and non-fiction journals, writers need a “hook” and paragraph explaining what`s new and exciting about their article and why they`re the person the magazine should contract with to write the article.

It is a fairly similar exercise, although in an investigation letter there is a tendency to use the first person. What is a summary? Abstracts, like all abstracts, cover the main points of a text. Unlike abstracts written for a non-specialist audience, abstracts use the same level of jargon and expertise as in the article itself. And unlike general abstracts, which in many ways can be customized to meet the needs of different readers and authors, abstracts typically consist of 150 to 250 words and follow established patterns. You need to show them this value quickly. You should tell the reader clearly and concisely (1) what problem the article is trying to solve and (2) what valuable original observations the article offers. Of course, the summary cannot go into detail. But it should at least give the reader a general idea of what the article brings. We have seen fabulous tips on writing a very good summary on other blogs (Dudziak and Volokh). They are perfect for getting the right tone and style that will impress student editors. A MadLib-style skeleton is missing from these instructions.

Sometimes it`s nice to sit back and not be creative in your creativity. (See the memes “Sh!t [insert very specific demographic here] People say.” If you have no idea what it is, click here.) Beginning authors or experienced researchers can all benefit from a 1040-EZ approach to abstract writing that conveys scientific meaning without being openly boastful. * Do not include citations, footnotes and references in the abstract. Finally, the last sentence links the argument to the case law: the sentence explains that this is an article that provides historical support for the Court`s precedents, rather than arguing against the Court`s precedents. Here is a draft of the new section on abstracting that will be published in the fourth edition of my book Academic Legal Writing. There is still plenty of time to improve it, so I would like to have some feedback. (By the way, the summaries I give as examples are my own, but I would prefer to use someone else`s summaries, especially if they are very effective. So if you have recommendations for very good summaries, please forward them.) * Always remember that your abstract must properly justify your topic. “The divorce rate has increased dramatically over the past 50 years.

Social discrimination, divergence in marital mentality; economic imbalance; There are actually many valid reasons that lead to divorce. The article takes a subjective look at the consummate qualities of family law and how it contains the event to the drop of water. It also places statistics on marital separation and its impact on the children of the marriage. It takes an objective look at existing legal strategies and also looks at some welcome changes that could change the course of the law in question. When you write a summary, you`re marketing your own work – you`re acting as your own PR agent. You`ve already done the work of writing your article, and now you need to do the good job of presenting your Lite-style research to article editors. Aside from your school`s letterhead, this is the most influential aspect of your work. Think of it like intellectual plastic surgery: you widen the outside to convey to others how you think you should be seen. (See Jocelyn Wildenstein) Abstracts of manuscripts submitted to the BMC series of medical journals should be structured as follows: background, methods, results and conclusions.

The context, results and conclusions are the same as for the biology journals above. In addition, the section should summarize the methods of conducting the study and mention the various techniques used.

How to Start a Small Business in Germany

Business tax is calculated from a combination of a uniform tax rate of 3.5% (basic rate) and a municipal tax rate. The amount of business tax you have to pay depends heavily on where your business is registered, as this tax is a municipal tax. Each municipal area and city has a different multiplier, called Hebesatz. It ranges from 200% to 900%, with an average of 402% in 2018. We know this sounds like a lot of gibberish at the moment, but we`ll give you an example calculation to help you understand. Several banks are responding to the growing need for modern banking services for small and medium-sized businesses, such as Kontist, Qonto and N26. Most of these banks also allow the connection of specific accounting software to simplify the bureaucratic burden. Unlike freelancers, who are exempt from this tax, you may have to pay business tax if you are self-employed with a trading company. Your obligation to pay business tax starts when your profit exceeds 24,500 euros per year.

This also means that you do not pay business tax on the first 24,500 euros of profit per year. The federal government and the various German and EU Länder have funding programmes to support business start-ups in Germany, especially in East Germany. These can include low-interest loans with long repayment periods and non-repayable grants. The KfW Group manages the largest promotional loans granted by the federal government. The Employment Agency also offers subsidies to recipients of unemployment benefits. Certain trades and professions in Germany are protected, so you need to take extra steps before you can register your company and start trading. As soon as you have registered your company, your registration information will be automatically transmitted to the tax office, the local trade association and, depending on the type of registration of the company, possibly also to the district court. However, bureaucracy is a trigger for many foreigners when it comes to setting up a business in Germany.

If you have any doubts or need help, you can contact firma.de who will be happy to guide you in English to start your business in Germany. Choosing the right structure is important because it will affect your corporate taxes and personal debt in the future. Individuals or companies wishing to move to Germany should seek advice from experts on legal, accounting and tax matters. This advice is available from private companies. In addition, various German authorities have information in English on their websites (as well as a number of downloadable brochures in English) that offer tips and advice on setting up a business, self-employment and a variety of other topics related to doing business in Germany. The amount varies depending on the amount to be invested, but the actual administrative burden is not too heavy. In general, there is a company registration fee of €400 in Germany, and to set up a GmbH, investors must subscribe to €25,000 of seed capital. However, setting up a “mini-GmbH” is much cheaper and requires an initial investment of as little as €1 (see below for more information on this type of business). For the establishment of a GmbH, one person is sufficient, for whom the share capital must be at least € 25,000. A notarized contract must be concluded between the partners, and the legal existence of the company only begins with its registration in the commercial register. The name of the GmbH must derive either from the corporate purpose or from the name of the shareholders and contain the addition “limited liability”. Shortly after registering your business with the trade office, you will receive a message from your local tax office, usually asked to fill out the “Tax Registration Questionnaire” form.

To speed up the process, you can also download a form to fill out or submit via ELSTER. The form is only available in German; If you are unsure of anything, it is advisable to consult a tax advisor instead of risking a delay due to incorrect entry of information. You must provide the following information: This is very important and it is an area where German differs from some other corporate cultures. There is chatter, but in German workplaces it is not normal for colleagues to talk about their private lives. The German way of working separates the personal and the private, so stick to professional matters. If you`re a freelancer or small business owner, you don`t need a business account1. You can use your personal bank account. Check your bank`s terms and conditions. Some banks don`t allow you to use your personal account as a business account1.

Before you can set up a company in Germany, you must first make sure that you are allowed to stay there long-term. Under EU law, citizens of the EU, EEA or Switzerland can live and work freely in Germany, including on their own account. A GA must have a board of directors which is authorised to decide on all matters relating to the operation of the company, which is appointed by the supervisory board and is accountable to it. The shareholders of an AGM exercise their power to issue instructions at ordinary general meetings. Information and contact details of private companies that promote their start-up services can be found on this website using the following links. For anyone who wants to become an entrepreneur, Germany can be a great place to start a new business. This is evidenced by the large number of small and medium-sized enterprises (SMEs) that form the backbone of the German economy. However, there are a few administrative issues that need to be addressed before you can officially become your own boss. In addition, an annual tax return must be filed for your business, in which you disclose all income and sales.

To work as a freelancer or start your own small business in Germany, you need to have several registrations and permits before starting your business in Germany. Not really. You just have to be organized. When you start your business, you`ll need to fill out a few forms, but there`s a lot of information online to help you. Your tax advisor can register a business for you. Firma.de can register a company for you. There are many resources to help business owners, including in English. The growth of German start-up culture has not been produced solely by German youth. The dynamics of Berlin and Munich are in fact an international phenomenon to which so-called expatriate entrepreneurs make an important contribution.

If your business idea does not qualify as a liberal profession, then you are a trader. Therefore, you must register with your city`s trade office to obtain a business license. If you run an online business, whether it`s an Etsy or Shopify shop, or a blog that makes money, you`ll need to register it as a business business. As an entrepreneur in Germany, you have to deal with numerous contracts, laws and legal regulations (e.g. leases for your office space, product liability, etc.). The great advantage: if all business transactions are contractually defined, you are guaranteed a high degree of legal certainty. In addition to general advice and guidance, EA`s English-speaking staff will personally advise you on setting up a business in Germany, help you fill out the forms and documents, and forward them to the relevant administrative authorities. EI can help you with many of the processes described below.

However, things have changed. Supported by the government`s Digital Agenda 2020, the e-commerce and information technology sectors play a much more important role. Berlin has become a haven for innovative software companies, web designers and marketers. Munich`s high-tech economy has embraced AI and new manufacturing techniques, while Frankfurt attracts a large number of financial entrepreneurs. Foreign entrepreneurs are always welcome to set up businesses in Germany, but if you are wondering how to start a business in Germany as a foreigner, there are some special considerations to consider. Look at the list of requirements below and tick off the various necessary documents, but there are also general issues. If you want to move to Germany and be self-employed and meet certain criteria, you will most likely receive a residence permit (for you and your family) if you can prove that your company has a positive impact on the German economy. Since there are many different forms of commerce, let`s look at the different legal forms and their meanings. There are three broad categories of business forms: It is a well-known fact that Germany has one of the strongest economies in the world.

How to Resign from Your Law Firm

Lawyer burnout can stem from high professional expectations or isolation, which can be mitigated by creating a more collaborative work environment among employees. Adjustments to the corporate culture in the office may include setting up conference rooms for impromptu meetings or collaborative work hours, or reorganizing your company`s departments to encourage cross-departmental collaboration. Mentorship programs, where entry-level professionals can learn from seniors, can also foster a collaborative work environment that employees can enjoy over the long term. If your company does seasonal work, try not to go during rush hour or during critical conflicts in a case. You may also want to read our tips for people leaving an internship – lots of networking tips apply twice to quit your job! I resigned last week (moving to an internal position) and am being “asked” to write a departure note to the partners in my firm, listing all the good and bad things about my experience with my firm. I`ve been asked to be brutally honest since “What are we going to do? Gets you fired? “, but I can`t. My design is now full of nothing but subtleties. A thorough review of conflicts is necessary before hiring a seniority lawyer. Start gathering the appropriate information early in your job search process so you can fill out the forms required by your potential employer`s professional liability insurer in a timely manner. Unfortunately, career changes can be thwarted or delayed by unexpected and intractable conflicts, while waivers are obtained.

Note: This happened to me, and I`m sure it happened to other people too. I was fired (by an Am100 company) when I was pregnant. It was ostensibly related to performance, but I had never received bad reviews. I took a lawyer and talked with them and ended up receiving a severance package of about 3 months` salary, in addition to regular maternity leave. I also signed a confidentiality agreement. So if you think your colleague suddenly decided not to come back from maternity leave, think again – she may have been fired and can`t talk about it. I`m still very PO`d in the business and how that probably contributes to how people perceive women of childbearing age. In terms of answering questions when you`re away, I think if there`s a quick answer to something (“oh, Sally in accounting keeps that list”), go ahead and give it, but if you`re asked to help with a major transition or if you`re basically asked to train someone, After you leave, I think you are simply saying that the duties of your new job prevent you from providing the level of support.

If you`re considering retiring from your current law firm, you want to make sure you`re doing it right so you don`t break bridges. If you quit unprofessionally, your credibility and relationships could be lost. When thinking about when you leave, be sure to review your employment contract if you have one. Some employment contracts provide for a minimum notice period, and your notice period may be longer than two weeks. Switching between law firms (or careers) as a lawyer is a bit more intense than the usual dismissal. Your firm will need to refer your files to another lawyer, and your clients have probably established a relationship with you. Not only do you need to inform the team members who will take charge of your files, but you may also need to discuss your planned outing with your clients, taking care to follow all applicable ethical rules. I have left two jobs in private law, I have always left at least six weeks in advance and I have good relationships with former colleagues in both places.

On the other hand, in my current job, several lawyers have only given two weeks` notice and it has not been well received. It may be different in other industries, but because of the time it takes to change things, I really think that greater notification is still a better practice for lawyers. If you`re very young, it may not be that important. Small note – I`m not a lawyer, but I don`t think the law firm`s spring bonuses, at least in Biglaw country, are in the low range of 4 as the post suggests. My other significant is a 4th year with a V5 company and receives $15,000 (I know there is a range, but the figure of 4 to 5, depending on the company and the class year, is closer to reality, from what I`ve heard). I simply moved from one company to another and quit two weeks ago. I charged about 4 hours each day before officially stopping and about 1-2 hours after. I don`t think anyone noticed or cared about it. As long as you don`t let anyone down and your clients` interests are protected, enjoy a part-time break. Review the partnership agreement – Partners should carefully review their partnership agreement for termination requirements, penalties or possible forfeiture. Plan your notice and departure to minimize penalties and meet needs.

How to Play King of the Court Tennis

If there is a situation where two teams end up with the same number of points at the end of a round, the first check is the longest stay on the king`s side. (A longest stay is the most important point collected during a tour on the king`s side). The team with the longest stay advances to the next round. Whether the individual residence values are also the same; The team with the longest stay first advances to the next round. The baseline is parallel to the mesh and defines the furthest boundary or back of the square on each side. The service line runs parallel to the network and marks the midpoint between the network and the baseline. It also marks the end of service boxes. Three or more players are required for this game. A person called “king” or “queen” goes to the other side of the court.

The other players form a line behind the baseline of the current page. A challenger enters and plays a single point against the “king”. The dot starts with a serve or drop hit. If the challenger wins, he replaces the “king” on the other side of the field. The variations of this game imply that the challenger must win two or three points in a row. This convenient game to play a single point. It`s important to note that King Of The Court should be played by time and not by points – this makes the game longer. If you play King Of The Court as a team, you also need to determine who will mark the different sections of the court before the game starts.

This avoids collisions. Also, communicating with your teammate improves the overall functioning of the game and is a great exercise for the real thing. This game of tennis requires players to work on their individual skills. In addition, players who challenge the king or queen must communicate to determine who comes forward and makes the first serve. In other words, King Of The Court improves a variety of aspects of your game. King Of The Court is designed to improve different aspects of your game. While just socializing with friends can be a fun game, your tennis skills will also improve after frequent training. If you want to get the most out of the training exercise, try playing as a team, as this will improve your communication skills.

For this game, you need at least three players. It can also be played as a team. You start by randomly selecting a player or team as king or queen. This player sits at one end of the playing field and faces the remaining players who position themselves behind the opposite baseline. A difficult player or team steps forward and participates in a one-on-one rally with the King/Queen. If they win, they take the position of king/queen. There are several variations of King Of The Court. If you want each set to last a little longer, you can have each challenger play with the king or queen in five sets. In other words, the challenger must win at least 3 sets out of 5 before replacing the king or queen.

King of the Court will be played with a total of 5 teams, 2 will be on the field, the others are waiting for their turn off the field. There is a king side of the court and a challenger side. Which team starts where is determined by draw. Each rally begins with a service of the team alongside the challengers. Each team is free to choose which player will serve. This game requires that there be a wall behind both baselines on the course. 4 individual players enter the field, with 2 positioned on each side on the baseline. All additional players are installed at the net post as substitutes. The game also requires a feeder, who stands out with a large basket of balls that quickly puts a new ball into play once the previous ball is offside. When the game begins, the 4 players on the field recover the ball back and forth with freedom of movement and aggressiveness.

The main objective of each player is not to be eliminated from the game by falling on a winner (a ball that bounces twice on the player`s playing field). If only one player makes a mistake on the ball, the player is replaced by the next person in the row, while the feeder immediately puts a ball in play on the opposite side (not injured). If a winner is hit, the player in whose field the ball lands (half of the field is also divided vertically), this player is eliminated from the game (it is also popular for a super shot or winner to hit through the middle of the field without making a final decision on which player to eliminate, which means that both players will be eliminated from the game on this page). As more eliminations occur, the number of substitutes decreases. If there are only 4 players left in play (no substitutes), an error will be penalized if the player runs back and touches the wall behind the baseline while a ball is put into play on the opposite side so that the other duo can hit a winner. With 3 players remaining, the same rules apply, but the single player must only defend one field. If there are 2 players left, they can decide among themselves whether they want to touch the wall or another penalty (dropping the racket and turning a full circle is a popular punishment). With this set rule, the 2 players play on a single full seat until one player remains to declare the winner. Once a new game starts, the highest ranked players from the previous game usually start as substitutes, with the winner replacing the last, the second replacing the second last, etc.

This game is designed to work on the advanced ability of consistency after running towards a shot, building shot placement and stamina. Tennis on grass, a game in which two opposing players (singles) or pairs of players (doubles) use tightly aligned rackets to hit a ball of a certain size, weight and jump over a net on a rectangular court. This is where tennis games come in. There are a variety of games you can consider, which means you can always improve your skills in one way or another. A person called “king” or “queen” goes to the other side of the court. The other players form a line behind the baseline of the current page. A challenger enters and plays a single point against the “king”. The dot starts with a serve or drop hit. The players are divided into two teams. Each team lines up behind the baseline or somewhere on the field that is safe.

A player from the service team starts the game and plays the point according to existing and traditional rules and tennis etiquette. Each player or double pair plays at least one entire rally. Once a player has played his rally(s), he goes to the end of his line and the next player in the line plays his team`s next point/rally. A minimum of eight players is required for this game. Two players start at the baseline, the back line of the tennis court, on each side, the court being divided vertically into two halves. Two tennis balls are played simultaneously on each half of the court, starting with a drop hit. A drop hit is a sneaky shot by bouncing the ball first. As soon as a player loses a point on his side of the playing field, he shouts “A live ball!” and the only remaining ball is played between the four players, the playing field no longer divided in the middle. The team that wins this point remains, while two new players on the other side replace the losing team and the game starts again with two balls. The first team to reach ten points wins.

This game is designed to practice basic shots, forehand and backhand, first, then doubles the strategy as soon as “One ball live” is called. Tennis games are often used to help players of all levels practice the different strokes in tennis. The number of participants required varies from two players to as many players as possible on a tennis court. These games are often used by tennis coaches and other instructors to teach basic tennis skills. A substitute may play for any player who may be incapacitated by illness or injury during the match, but not for any reason without the consent of the opposing captain.
